Terms and Conditions for Online Bookings

These Terms and Conditions (“Terms”) govern all bookings made through the online booking system on this website (the “Website”), operated by Donaghmore Famine Workhouse and Agricultural Museum Company Ltd. By Guarantee, a company registered in Ireland under company number 663160, with its registered office at Dunacleggan, Donaghmore, Co. Laois, R32 PC58, Ireland (“we”, “us”, “our”).
By making a booking through our Website, you (“the Customer”, “you”) confirm that you have read, understood and agree to be bound by these Terms, along with our Privacy Policy and Cookie Policy.
1. Definitions
- “Booking” means a reservation for an activity, tour, experience or service made through our online booking system.
- “FareHarbor” means the third-party online booking and payment platform integrated into our Website, through which bookings, payments and related customer data are processed.
- “Order Confirmation” means the email or notification confirming your Booking, generated automatically by FareHarbor on our behalf.
2. Our Online Booking System
2.1 Bookings made through our Website are processed using FareHarbor, a third-party booking platform. When you make a Booking, you will be transferred to, or interact with, an embedded FareHarbor checkout to complete your purchase.
2.2 FareHarbor acts as our data processor and payment intermediary for the purposes of taking bookings and payments on our behalf. We remain responsible for the service, activity or experience you have booked. Details of how FareHarbor handles your personal data are set out in Section 9 (Data Protection and Privacy) below.
2.3 It is your responsibility to check all details on the Order Confirmation, including the date, time, number of participants and any special requirements, and to notify us immediately of any errors.
3. Prices and Payment
3.1 All prices are displayed in euro (€).
3.2 Payment is taken securely through FareHarbor’s payment processing system at the time of booking, unless a deposit or “pay later” option is offered and selected. We do not store your full payment card details.
3.3 We reserve the right to amend prices at any time. Changes will not affect a Booking already confirmed.
3.4 Payment on arrival is possible.
4. Booking Confirmation
4.1 A Booking is only confirmed once you have received an Order Confirmation from FareHarbor by email. Please check your spam or junk folder if you do not receive this within a reasonable time.
4.2 We reserve the right to decline or cancel a Booking, for example where an activity is fully booked, cancelled due to weather or safety concerns, or where incorrect information has been provided. In such cases, you will be offered a full refund or an alternative date.
5. Cancellations, Amendments and Refunds
5.1 Cancellation and amendment requests must be made in accordance with the specific cancellation policy shown at the time of booking and on your Order Confirmation.
5.2 Customers will receive a full refund or credit with 24 hours notice of cancellation. Customers will also receive a full refund or credit in case of operator cancellation due to weather or other unforeseen circumstances. Contact us by phone to cancel or inquire about a cancellation. No-shows will be charged the full price.
5.3 Refunds, where due, will be processed through FareHarbor to the original payment method within 10 business days. In rare cases, this may take up to 30 business days to appear on your statement.
6. Right of Withdrawal (Cooling-Off Period)
6.1 Under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, and the wider EU Consumer Rights Directive, consumers generally have a 14-day right of withdrawal from distance contracts.
6.2 However, bookings for leisure activities, tours, accommodation, transport or events that specify a particular date or period of performance are exempt from this right of withdrawal, as permitted under the Regulations. This means that once you have booked a specific date or time slot for an activity through our Website, the standard 14-day cooling-off period does not apply, and the cancellation terms in Section 5 will govern instead.
6.3 This does not affect any statutory rights you have where the service is not provided as described, is faulty, or is not performed with reasonable care and skill.
7. Force Majeure
We shall not be liable for any failure or delay in providing a Booking where this is caused by circumstances beyond our reasonable control, including but not limited to extreme weather, natural disaster, government restriction, strike, civil unrest, pandemic or infrastructure failure.
8. Liability
8.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be excluded or limited under Irish law.
8.2 Subject to Section 8.1, our total liability to you arising out of or in connection with a Booking shall not exceed the total amount paid by you for that Booking.
8.3 We are not liable for any indirect or consequential loss, including loss of enjoyment, travel costs or third-party expenses arising from a cancelled or amended Booking.
9. Data Protection and Privacy
9.1 We process your personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Irish Data Protection Act 2018.
9.2 When you make a Booking, your personal data (such as name, email address, phone number and payment information) is collected and processed by FareHarbor on our behalf, acting as our data processor, in order to manage your Booking, process payment and send you communications relating to your activity.
9.3 FareHarbor may also act as an independent data controller for certain purposes, such as its own service improvement and fraud prevention, in accordance with its own privacy policy, available at https://fareharbor.com/legal/privacy/.

9.5 You have the right to lodge a complaint with the Data Protection Commission (DPC) in Ireland if you believe your personal data has been mishandled: www.dataprotection.ie.
10. Cookies
Our Website, including the embedded FareHarbor booking widget, uses cookies and similar technologies to operate the booking system, remember your preferences and analyse Website usage. For more information, please see our Cookie Policy.
11. Intellectual Property
All content on this Website, including text, images, logos and the booking interface, is owned by or licensed to us and may not be reproduced without our prior written consent.
12. Complaints and Online Dispute Resolution
12.1 If you have a complaint about your Booking or our service, please contact us in the first instance at info@donaghmoremuseum.ie or 086 8296685.
12.2 If you are an EU consumer and are unable to resolve a complaint with us directly, you may use the European Commission’s Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr.
12.3 You may also contact the Competition and Consumer Protection Commission (CCPC) in Ireland for general consumer advice: www.ccpc.ie.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland, without prejudice to any mandatory consumer protection rights you may have in your country of residence within the EU.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services or legal requirements. The version published on this Website at the time of your Booking will apply.
